Acceptance, Scope, and Privacy

These Terms of Use ("Terms") govern your use of mitigate608.com (the "Site"), which is operated by Mitigate608 LLC ("Mitigate608," "we," "our," or "us"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms apply only to your use of the Site. They do not govern any mitigation, restoration, or other services we perform. Those services are governed by a separate written agreement between you and Mitigate608. If these Terms and that agreement conflict, the agreement controls for those services. Other applications, portals, or tools that Mitigate608 uses or provides are governed by their own terms, not these Terms.

Our Privacy Policy also governs your use of the Site and is incorporated into these Terms.

Emergencies

The contact form on the Site is not for emergencies. Submissions may not be reviewed right away. For emergency service, call us at (608) 313-4314. If anyone is in immediate danger, or you suspect a gas leak, electrical hazard, or structural collapse, call 911 first.

Using the Site

Eligibility. The Site is intended only for people who are 18 years of age or older and who live in Wisconsin. By using the Site, you represent that you meet these requirements.

Prohibited uses. You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• use the Site in any way that violates any law or regulation
• submit false, misleading, or fraudulent information through the Site
• introduce viruses, malware, spyware, or other harmful code
• try to gain unauthorized access to the Site, its servers, or any connected system
• interfere with or disrupt how the Site works, including through denial-of-service attacks
• use robots, scrapers, or other automated means to access or collect Site content without our permission
• use the Site to send spam or unsolicited advertising

Termination of access. We may restrict, suspend, or end your access to the Site at any time, for any reason, without notice, including if we believe you have violated these Terms.

Law enforcement. We may cooperate fully with law enforcement authorities or court orders that request or direct us to disclose the identity or other information of anyone using the Site.

Site Content and Third-Party Links

General information only. The content on the Site, including information about water damage, mold, asbestos, sewage, storm damage, indoor air quality, and insurance claims, is general information only. It is not professional, legal, insurance, health, or safety advice for any specific property or situation. Do not rely on Site content in place of an in-person inspection or advice from a qualified professional. We do not guarantee that any information on the Site is accurate, complete, or current, and we may change it at any time without notice.

No guarantees. Nothing on the Site guarantees:

• a response time or arrival time
• the availability of any service in any location
• a price, estimate, or cost
• insurance coverage, claim approval, or claim results
• the results of any service

Any commitment about services applies only if it appears in a separate written agreement signed by Mitigate608.

Third-party links. The Site may link to websites operated by third parties, including social media platforms. We do not control or monitor those websites and are not responsible for their content, policies, or practices. You access them at your own risk and subject to their terms.

Changes to These Terms and the Site

We may revise these Terms at any time by posting an updated version on the Site. Changes take effect when posted. If you keep using the Site after we post changes, you accept the revised Terms.

We may also change, suspend, or discontinue all or part of the Site at any time without notice. We are not liable if all or part of the Site is unavailable at any time or for any period.

Intellectual Property and Trademarks

Our content. The Site and its content, features, and functionality, including text, graphics, photos, logos, and design, are owned by Mitigate608 or its licensors and are protected by copyright, trademark, and other laws. You may view and print Site content for your personal, non-commercial use. You may not copy, modify, distribute, republish, or create derivative works from Site content without our prior written permission.

Our marks. "Mitigate608," our logo, and related names, slogans, and designs are trademarks of Mitigate608 LLC. You may not use them without our prior written permission.

Third-party marks. Other names, logos, and marks on the Site, such as certification, membership, and association marks, belong to their respective owners. We display them only as permitted by those owners, for example because of our certification by or membership in that organization. Their appearance on the Site does not mean the owner endorses or sponsors Mitigate608 except as the certification or membership itself indicates.

Copyright complaints. If you believe content on the Site infringes your copyright, email hello@mitigate608.com. Include a description of the work, where it appears on the Site, and your contact information.

Disclaimers, Limitation of Liability, and Indemnification

Disclaimer of warranties. THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SOME LAWS DO NOT ALLOW CERTAIN WARRANTIES TO BE EXCLUDED, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, MITIGATE608 AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS (US$100). THIS PARAGRAPH APPLIES ONLY TO THE SITE. IT DOES NOT CHANGE ANY LIABILITY TERMS IN A SEPARATE SERVICE AGREEMENT.

Indemnification. You agree to indemnify, defend, and hold harmless Mitigate608 and its members, managers, employees, and agents from any third-party claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.

Governing Law and Venue

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-law rules. Any legal action arising out of or related to these Terms or the Site must be brought exclusively in the state courts located in Rock County, Wisconsin, or in the federal courts for the district that includes Rock County. You consent to the jurisdiction of those courts.

General Terms

Waiver. If we do not enforce any part of these Terms, that is not a waiver of that part or any other part.

Severability. If a court finds any provision of these Terms invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the rest of these Terms will remain in full effect.

Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and Mitigate608 about the Site. They replace any prior understandings about the Site. They do not replace any separate service agreement.
